ToS for Digital Art

Details and Reference

Please give as much detail as possible. Reference sheets are a plus but are not required. If details and/or reference are not clear before the commission has begun, then there will be an extra charge for any change to the finished artwork.

Content

The artist will not draw or accept commissions of an extreme or explicit nature. The artist will only accept tasteful or adult commissions from clients 18 years of age or older. The artists will not accept any commissions of a violent or extreme fetish nature.

Payment

All commissions under $200 must be paid in full! Currency is USD. Any commission of $200 or larger will be available for installment plans. PayPal invoices are expected within 48 hours of an accepted commission. Failure to pay during the allotted time will result in cancellation of the commission. Please keep in mind that prices on display are minimum estimates. A price must be agreed upon by both the artist and client before the commission begins.  All commissions are handled on a case by case basis.

Art Process

The artist will allow three changes during the sketch phase. After three changes there will be a minimum $5 fee PER change. No changes will be made after the sketch phase.  There will be no additional charges for artist error.  Maximum completion time can be up to three months. Should the artist encounter an unexpected delay, the client will be notified ASAP! Prior to finalization of the commission agreement, the client must identify any time limits for completion. The artist does not allow due dates earlier than two weeks. Please note that the artist may work on the client’s commission during a live stream. If so, the client will be contacted 24 hours in advance.

Canceling and Refund Policy

The artist has the right to cancel and refund money for the client’s commission at any time! If money hasn’t been sent yet the client has the right to cancel the commission. If a commission is being worked on, a partial refund may be granted. (ex. sketch phase, line art phase, etc.) A full refund is non-negotiable on artworks that have been started. If the client disputes a commission charge with their credit card company, the artist will no longer accept commissions from the client and the client’s name may be posted publicly for other artists as an artist beware.

Copyright and Usage Policy

The artist holds every right to the produced art, not the client. Therefore, the artist can use the artwork within any place or site. If the client wants the artwork to be private, then there will be a fee added to the final pricing. Clients can use commissioned art for personal use only, i.e., print the art and claim the right of their character(s) but not the art itself, and use the art to promote themselves with proper credit given to the artist.  Any copyright infringement will result in revocation of the client’s right to the artwork. The following is considered copyright infringement: reproducing/using the copyrighted artwork commercially (meaning using the art to make money in any way), taking credit for the creation of the artwork, removing any watermarks/signatures, or altering the artwork in any way without my, the artist’s, consent.

Shipping and Originals

The commission price does not include shipping fees.  Shipping fees will be added to the final cost of the commission. Fees will vary depending on the carrier as well as the destination. For digital commissions, the client will receive a high-resolution file along with a smaller, resized file (if specific size is needed, this will be discussed before agreeing upon a final price).

Other

Prices will not be negotiated. The artists will notify you via email should there be any production delays. Please do not ask for daily updates on your commission; however, if a week or more has passed by, please feel free to email the artist.

By sending payment, you the client, are agreeing to the above terms and services.

Thank you for commissioning Seraphim Artistry!
